All orders placed through our Site constitute an offer by you to purchase food products subject to these Terms. An order confirmation sent to your email address constitutes our acceptance of your offer and the formation of a binding contract between you and Pizzana.

We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to: unavailability of menu items, errors in pricing or descriptions, suspected fraudulent activity, or delivery limitations in certain areas. If an order is cancelled after payment has been processed, a full refund will be issued through the original payment method.

5.2 Pricing

All prices displayed on our Site are in United States Dollars (USD) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without prior notice. Delivery fees, service charges, and applicable taxes will be clearly displayed at checkout prior to final order confirmation.

In the event of a pricing error on our Site, we reserve the right to cancel any orders placed at the incorrect price, with full refunds provided. We are not obligated to honor pricing errors, even after an order confirmation has been issued.

Additional charges may apply for re-delivery attempts where applicable.

Risk of loss and title to food products pass to the customer upon delivery to the specified address or upon pickup at our location.

For users located in California, additional rights may apply under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), California Business and Professions Code Section 17200 et seq. Subject to the arbitration provision set forth in Section 13 below, any legal action or proceeding arising out of or related to these Terms or the services provided by Pizzana shall be instituted exclusively in the federal or state courts of competent jurisdiction in the United States. 13. Dispute Resolution and Arbitration

Judgment on the arbitration award may be entered in any court having jurisdiction.

The arbitration shall be conducted in the English language. The arbitrator shall have the authority to award any relief that would be available in a court of law. The arbitrator's decision shall be final and binding on the parties.

13.3 Class Action Waiver

YOU AND PIZZANA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. If this class action waiver is found to be unenforceable, then the entire arbitration provision shall be null and void.

13.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information. Small claims court actions, where eligible, are also excluded from the arbitration requirement.

No oral statement, advertisement, or other representation made by any employee or representative of Pizzana shall modify or supplement these Terms unless expressly incorporated into a written agreement signed by an authorized representative of Pizzana.

Pizzana shall not be liable for any failure or delay in performance of its obligations under these Terms arising out of or caused, directly or indirectly, by circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics or epidemics, government orders or regulations, labor disputes, power outages, internet failures, civil unrest, terrorism, or any other event that renders performance impractical or impossible. In the event of a force majeure event, Pizzana will use commercially reasonable efforts to resume performance as soon as practicable.
